Terms of Service
Currents App Inc. · Effective: September 23, 2026
These Terms of Service ("Terms") are an agreement between you and Currents App Inc., a Delaware corporation ("Currents," "we," "us"). They govern your use of the Currents apps, websites, dashboards, door tools, and related services (together, the "Platform").
Please read Section 22 (Arbitration). It requires most disputes to be resolved by individual arbitration, waives class actions and jury trials, and explains how to opt out.
By creating an account, buying a ticket, or otherwise using the Platform, you agree to these Terms and our Privacy Policy. If you use the Platform for a business (for example, a venue or a party brand), you agree on behalf of that business and confirm you are authorized to bind it.
Part A — Everyone
1. How these Terms are organized
Part A applies to everyone.
Part B applies to Riders (people who discover, attend, and buy on Currents).
Part C applies to Organizers — Curators, DJs, and Venues — with role-specific sections in Parts D, E, and F.
Part G is the Refund Policy.
Part H covers conduct, bad actors, and enforcement for every role.
Part I covers liability, disputes, and legal terms.
If you hold more than one role (for example, a DJ who also runs a party), each applicable Part applies to that activity.
2. Definitions
Currents uses its own vocabulary. In these Terms:
- Wave — a nightlife event, party, or performance listed on the Platform.
- Room — a physical venue where Waves take place.
- Hub — a DJ's public page on the Platform.
- Curator — a promoter, party brand, or collective that organizes Waves.
- Venue — the operator of a Room, including its owners, managers, and staff.
- DJ — a performing artist with a Hub.
- Organizer — any Curator, DJ, or Venue that lists a Wave, sells tickets, or receives payouts through the Platform. The Organizer of a ticketed Wave is the account that created the listing and receives its payout.
- Rider — a person using the Platform to discover, attend, or buy.
- Drift — a non-binding signal of interest in a Wave. A Drift is not a reservation, ticket, or promise of entry.
- Ride / Riding — being physically present at a Wave, as detected by the Platform.
- Trace — a live presence contribution a Rider chooses to share while Riding.
- Pulse and Heat — the Platform's aggregate, real-time estimates of a Room's energy, shown on a scale from Cool to Cresting.
- Echo — short-lived post-Wave content and signals.
- Circle — the Platform's features for loosely coordinating with people you choose.
- Whisper — private messages between users.
- Bless the DJ — voluntary tips paid to a DJ through the Platform.
- Skip the Bar and Going Big — in-venue drink ordering and bottle service, where available.
- Signals — Drifts, Rides, Traces, Echoes, Pulse, Heat, and similar Platform data.
- Content — anything you submit, including text, images, audio, video, lineups, and Wave details.
3. Eligibility
You must be at least 18 years old to create an account. Currents is not directed to anyone under 18.
Individual Waves may carry higher age requirements (commonly 21+). Organizers and Venues set and enforce those requirements at the door.
Any feature involving alcohol requires you to be 21 or older and to present valid ID when served.
You may not use the Platform if we have previously removed you, or if you are barred from doing so under applicable law.
4. Your account
Provide accurate information and keep it current. One person, one Rider account.
You are responsible for activity on your account and for keeping your login secure. Tell us immediately at info@thecurrentsapp.com if you suspect unauthorized access.
Business accounts must be registered to the actual business or individual who performs, promotes, or operates. You may add team members, and you are responsible for their actions.
5. What Currents is — and isn't
Currents is a marketplace and technology platform. Currents does not organize, host, produce, or operate Waves, and does not own or operate Rooms. Organizers and Venues are solely responsible for their Waves, including lineups, safety, security, entry, capacity, licensing, alcohol service, accessibility, and compliance with law.
Signals are estimates. Pulse and Heat are generated from limited, aggregated data and may be delayed, incomplete, or inaccurate. They describe a moment, not a guarantee of what you will experience. Lineups and set times are supplied by Organizers and may change.
6. Fees
Riders pay one Currents fee of 10% plus $0.99 per paid ticket, on top of the ticket's face price. There is no Curator fee. The total price, including the Currents fee and any required taxes, is shown before you pay.
Organizers keep the ticket's face price. Currents does not charge Organizers a separate platform fee on ticket sales.
Taxes are added where required.
We may change fees prospectively with notice. Changes do not affect purchases already completed.
7. Payments
Payments are processed by our payment partner, Stripe. By paying or receiving payouts, you also agree to Stripe's applicable terms, including the Stripe Connected Account Agreement for Organizers. Currents does not store full card numbers.
8. Your Content and license to us
You own your Content. You grant Currents a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (for formatting), display, and distribute your Content to operate, promote, and improve the Platform. For public Content (Wave listings, Hubs, lineups, flyers), this license continues for Content already distributed in marketing materials at the time you delete it.
You confirm you have the rights to everything you submit, including names, logos, flyers, photographs, and music, and that your Content does not violate anyone's rights or the law.
9. Listings sourced from public information
To make nightlife legible, Currents may create listings for Waves, Rooms, and DJs using publicly available information (such as public event calendars, venue websites, and public social media). If a listing is about you or your business, you may claim it to control it, or ask us to correct or remove it at info@thecurrentsapp.com. We will act on verified requests promptly.
10. Our intellectual property
The Platform, the Currents name and marks, our vocabulary as used on the Platform, designs, and software belong to Currents or our licensors. Except for the rights expressly granted here, nothing transfers to you. Feedback you give us may be used without obligation to you.
11. Changes to the Platform and these Terms
We may add, change, or remove features. We may update these Terms; if a change is material, we will give notice in the app or by email at least 14 days before it takes effect, except where a change is required by law or addresses abuse. Continued use after the effective date means you accept the update.
12. Third-party services
Waves may link to or rely on third parties (Venues, payment processors, maps, music platforms). Their terms and practices govern their services. Currents is not responsible for them.
12A. Beta features and testing
Some features are labeled beta, preview, or test, and closed testing groups may use the Platform before public launch.
Beta features may be incomplete, may change without notice, or may be removed.
Data created during testing may be reset, including test Waves, Signals, and attribution history.
Transactions during testing are real unless clearly labeled otherwise, and Part G applies to them.
If you're in a closed testing group, keep non-public features and information confidential until we launch them publicly.
Feedback you give during testing belongs to Currents (Section 10).
12B. Photography and filming at Waves
Waves are often photographed, filmed, and recorded. By attending a Wave, you acknowledge that you may appear in photos, video, or audio recorded by the Organizer, the Venue, other attendees, or Currents.
Waves hosted or co-hosted by Currents. You grant Currents a perpetual, worldwide, royalty-free license to use recordings of you from that Wave for marketing, promotional, and business purposes, without compensation. This includes your name and likeness as captured. Where practical, we'll post notice at the entrance and offer a way to opt out of filming, such as a marked wristband. If you ask us to stop using a recording that prominently features you, we'll stop new uses where reasonably possible.
Other Waves. Organizers and Venues are responsible for their own filming notices and releases (Section 17).
Content you post. Treat identifiable people in your Echoes and other Content with respect. We may remove Content featuring a person who asks us to, where it violates Part H or their privacy.
12C. Platform Data
"Platform Data" means data generated by the operation of the Platform. It includes Signals, Pulse and Heat history, attendance and entry records, DJ-verified attendance, Curator attribution history, Wave performance metrics, rankings, and aggregated insights.
Ownership. As between you and Currents, Currents owns Platform Data, including Platform Data describing your Waves, sets, or Room. Your Content remains yours (Section 8).
Organizer license. While their account is in good standing, Organizers get a limited, non-exclusive, non-transferable license to view and use the Platform Data shown in their dashboards for their own business. That includes sharing summary results with booking partners and using them in their own promotional materials.
Restrictions. Organizers may not export Platform Data in bulk, move it to another platform, or use it to build, train, or improve a competing product.
Personal information. Rider personal information within Platform Data remains subject to the Privacy Policy.
On account closure, Organizers may request a summary export of their Waves' sales and payout records.
12D. Copyright policy
Currents respects intellectual property rights and responds to notices of alleged infringement under the Digital Millennium Copyright Act (DMCA).
Reporting infringement. Send our Copyright Agent a written notice that includes:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim is infringed.
- Identification of the material you claim is infringing and where it appears on the Platform, with enough detail for us to find it.
- Your contact information: address, phone number, and email.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.
Copyright Agent: Currents App Inc., Attn: Copyright Agent · info@thecurrentsapp.com
Counter-notice. If your Content was removed and you believe it was a mistake or misidentification, you may send a counter-notice as the DMCA permits. We may then restore the Content unless the complainant tells us within 10–14 business days that it has filed a court action.
Repeat infringers. We terminate the accounts of repeat infringers in appropriate circumstances.
12E. Promotions, promo codes, referrals, and ambassadors
Promo codes and credits have no cash value. Unless stated otherwise, they are non-transferable, limited to one per person, and may expire. We may void codes or credits obtained or used through fraud, abuse, or error, and reverse related purchases or rewards.
Referral programs pay rewards under the program terms shown at the time. Self-referrals, fake accounts, spam, and paid or incentivized sign-ups are prohibited, and rewards earned that way may be withheld or reversed.
Ambassadors and promoters. Anyone promoting Currents in exchange for anything of value — money, free tickets, credits, or perks — must clearly disclose that relationship in every promotion, as the FTC's endorsement rules require (for example, "#ad" or "Currents ambassador"). Ambassadors must not make false or misleading claims and must follow any rules of their school or campus. A separate ambassador agreement governs ambassador programs.
Organizer promotions. Organizers are responsible for making sure their own giveaways, contests, and promotions comply with law.
12F. How Waves are ranked
Discovery is ranked using factors such as:
- Your selected scenes and moods, and the DJs you follow.
- Signals such as Drifts and Heat.
- Timing and distance.
- Listing completeness and Organizer standing.
Rankings are not endorsements. If Currents offers paid or promoted placement, promoted Waves will be clearly labeled "Promoted." No one can pay to change Pulse, Heat, or Signals.
Part B — Riders
13. Drifting, Riding, and social features
A Drift signals interest only. It does not hold a spot, reserve a ticket, or guarantee entry.
Presence features (Ride, Trace, Circle visibility) depend on your device settings and your choices. You control what you share; see the Privacy Policy.
Whisper and Circle are for genuine coordination. You may not use them to harass, solicit, spam, or track anyone.
14. Tickets
A ticket is a revocable license from the Organizer to attend a Wave, subject to the Organizer's and Venue's entry policies (including age, ID, dress code, capacity, and conduct).
Venues and Organizers may refuse entry or remove you for safety, capacity, intoxication, conduct, failure to meet age/ID requirements, or policy violations. Refunds in those cases are governed by Part G.
Tickets are tied to your account. Tickets may be transferred only through Platform features that support transfer, where the Organizer allows it. Resale above face value is prohibited except through a Currents resale feature, if and where offered.
Tickets obtained through fraud, bots, stolen payment methods, or violation of purchase limits may be cancelled without refund.
15. Bless the DJ (tips)
Tips are voluntary and go to the DJ, less the fees shown at the time of tipping. Tips are final and non-refundable except for proven fraud, duplicate charges, or processing errors.
16. Skip the Bar and Going Big (where available)
When in-venue ordering is offered:
The Venue is the seller of all food and beverages, including alcohol, and holds all required licenses. Currents only transmits your order and payment.
You must be 21+ to order alcohol and must show valid ID when served. The Venue may refuse service for any lawful reason, including intoxication; refused orders are refunded as described in Part G.
Bottle service minimums, deposits, and table terms are set by the Venue and shown before you commit.
Ordering may unlock only when you are detected inside the Room.
16A. Attending Waves: assumption of risk
Nightlife carries risks. These include crowds, loud sound, alcohol, low lighting, late hours, travel at night, and the conduct of other people. You attend Waves voluntarily. To the fullest extent permitted by law, you assume the risks of attending, including injury, illness, property loss, and hearing damage.
Drink responsibly, plan safe transportation, and never drive impaired.
This section does not limit the responsibility of Organizers or Venues for their own negligence or legal violations. It does not release any liability that the law does not allow to be released.
Part C — Organizers (Curators, DJs, and Venues)
17. Organizer obligations
When you list a Wave, sell tickets, or receive payouts, you agree that:
Listings are accurate. Date, time, Room, lineup, age policy, prices, capacity, and refund terms are truthful and kept current. You may list a DJ only if that DJ is actually booked or has authorized the listing.
You are responsible for your Wave, including permits, licenses, insurance, security, safety, capacity limits, accessibility, alcohol service, music performance licensing, and all applicable laws.
You honor tickets. Every valid ticket holder who meets posted entry requirements is admitted, subject to lawful safety decisions.
You issue refunds as required by Part G and by law. Refunds are funded from your proceeds.
You do not discriminate on the basis of race, color, religion, national origin, sex, gender identity, sexual orientation, disability, or any other protected characteristic in pricing, entry, or treatment.
You pay the people you book according to your agreements with them.
You protect Rider data received through the Platform, use it only to run the Wave and as permitted by the Privacy Policy, and never sell it.
You carry insurance.
- Curators and Venues maintain commercial general liability insurance of at least $1,000,000 per occurrence.
- Venues that serve alcohol also maintain liquor liability insurance.
- Policies name Currents App Inc. as an additional insured where the policy allows.
- You provide certificates of insurance on request.
- DJs who only perform are exempt unless they organize the Wave.
You give filming notice. If you photograph or film at your Wave, you post clear notice at entry and obtain any releases the law requires for commercial use of attendees' likenesses.
18. Payment collection and payouts
Limited payment collection agent. For ticketed Waves, the Organizer is the seller. The Organizer appoints Currents as its limited agent to collect payments from Riders. A Rider's payment to Currents satisfies the Rider's obligation to the Organizer.
Payouts are sent through Stripe to your connected account on the schedule shown in your Stripe payout settings, less refunds, chargebacks, and amounts owed to Currents. Currents does not deduct a Curator fee. This page does not state a payout window.
Reserves and holds. We may delay a payout, hold a reserve, or require payout after the Wave rather than before it when we reasonably see elevated risk — for example, a new Organizer, unusual sales patterns, a high refund or chargeback rate, a complaint, a Wave change, or a suspected policy violation.
Chargebacks and refunds. You are responsible for refunds you owe and for chargebacks on your sales, plus related fees. If your balance is insufficient, we may deduct amounts from future payouts, charge your payment method on file, or collect them as a debt.
Taxes. You are responsible for taxes on your sales and income. We may collect tax information and issue tax forms as required.
Unclaimed funds. If we can't pay you because your payout account is incomplete, closed, or unverified, we'll hold the funds and try to contact you. Funds that remain unclaimed may be treated as abandoned property and sent to the appropriate state as required by law.
19. Data and dashboards
Dashboards provide Organizers with Wave performance, sales, and aggregated audience insights. Audience insights are aggregated and may not be used to identify, contact, track, or target individual Riders beyond what the Platform expressly provides (for example, a ticket holder list for door operations). You may not export, scrape, resell, or combine Platform data with other data to re-identify Riders.
Once you receive Rider information through the Platform, you are responsible for how you use it as an independent business. You must maintain your own privacy policy covering that use. You may send marketing only to Riders who have opted in to hear from you.
20. No circumvention
You may not use the Platform to find, market to, or sell to Riders and then move the resulting ticket sales or payments off the Platform to avoid fees. This includes directing Riders who discovered your Wave on Currents to buy elsewhere, or listing a Wave on Currents with a "buy tickets" link to another service, unless we have agreed otherwise in writing.
Part D — Curators
Lineup truth. Every DJ on a lineup must be booked or have given you permission. Misrepresenting a lineup to sell tickets is a serious violation (Part H).
Cancellations and material changes. If you cancel or materially change a Wave, you must notify us and ticket holders promptly through the Platform. Refunds follow Part G.
Capacity. You may not sell more tickets than the Room's lawful capacity allocated to your Wave.
Attribution. Curator attribution history on the Platform (Waves run, performance, payouts) reflects actual Platform activity and may not be manipulated.
Venue relationship. You are responsible for having the Venue's permission to hold your Wave in its Room.
Part E — DJs
Hub accuracy. Your Hub and set schedule must reflect real bookings. Do not claim sets you aren't playing or affiliations you don't have.
Showing up. You are responsible to the Organizer for your booking. Repeated unexcused no-shows may affect your Hub visibility and account standing.
Music rights. You are responsible for the rights to any recordings, mixes, or clips you upload to the Platform. Public performance licensing at a Wave is the responsibility of the Organizer and Venue as agreed between you.
Audience data shown to you (Set Pulse, audience composition) is aggregated and subject to Section 19.
Tips are paid out to you per Section 18.
Part F — Venues
Authority. You confirm you operate the Room and hold all licenses required for your operations, including alcohol licenses.
Accurate Room information. Location, capacity, age policy, accessibility, and entry policies must be accurate.
Door operations. Staff using Currents door tools must use them only to verify tickets and manage entry for the current Wave, and must not copy, photograph, or retain Rider information.
Alcohol. For Skip the Bar and Going Big, you are the seller of record for all beverages, you control whether to serve, and you are solely responsible for ID checks, responsible service, and dram shop compliance.
Pulse inputs. You may not feed false data into Pulse (for example, fake entries or orders) or interfere with how it is calculated.
Part G — Refund Policy
G1. General rule
All ticket sales are final except as stated in this Refund Policy, in the Organizer's posted refund terms (which may be more generous but never less generous than this policy), or as required by law.
G2. When Riders are entitled to a refund
G2A. Shutdowns and events outside anyone's control
G3. When refunds are not available
You changed your mind, couldn't attend, or arrived after doors closed.
You were refused entry or removed for failing to meet posted age, ID, dress code, or conduct requirements, or for intoxication.
A supporting (non-headliner) DJ changed, set times shifted less than the threshold above, or Pulse/Heat did not match your experience.
Your ticket was cancelled for fraud or a violation of these Terms.
G4. Orders, bottle service, and tips
Skip the Bar: If a Venue does not fulfill an order or refuses service, the order is refunded in full. Fulfilled orders are final.
Going Big: Deposits and minimums follow the Venue's terms shown before purchase. Cancellations by the Venue are refunded in full.
Bless the DJ: Final (see Section 15).
G5. How to request a refund
Request refunds in the app from the ticket or order, or at info@thecurrentsapp.com. Approved refunds go back to the original payment method, usually within 5–10 business days depending on your bank.
G6. Who pays for refunds
Refunds are funded by the Organizer or Venue that received the sale. Where Currents fronts a refund owed by an Organizer, we may recover it under Section 18.
G7. Chargebacks
Please contact us before disputing a charge with your bank; we usually resolve issues faster. Filing a chargeback for a purchase you received or used ("friendly fraud") is a violation of these Terms and may result in account suspension.
Part H — Conduct, Bad Actors, and Enforcement
H1. Rules for everyone
You may not:
- Harass, threaten, stalk, dox, or intimidate anyone, on or off the Platform, using information obtained through it.
- Use Signals, Traces, Circle, or Whisper to locate, follow, or monitor a person who has not chosen to share with you.
- Spoof your location, fake presence, or otherwise manipulate Drifts, Rides, Traces, Pulse, Heat, or rankings — including with bots, scripts, device farms, purchased accounts, or coordinated fake activity.
- Create fake or duplicate accounts, impersonate any person or business, or misrepresent your affiliation.
- Scrape, crawl, or harvest data from the Platform, or reverse engineer it, except as permitted by law.
- Buy tickets using bots or automation, evade purchase limits, or resell tickets in violation of Section 14.
- Use stolen payment methods, commit payment fraud, or file bad-faith chargebacks.
- Post Content that is unlawful, hateful, sexually explicit involving minors, violent, defamatory, or infringing, or that promotes illegal drugs or the sale of weapons.
- Share others' personal information without consent, including photos or presence data.
- Interfere with the Platform's security or operation.
H2. Additional rules by role
Riders may not: attempt entry with a ticket they know is invalid; misrepresent age; abuse, threaten, or harass DJs, door staff, or venue staff; or use Whisper for unsolicited sexual content, commercial solicitation, or spam.
Curators may not: list phantom Waves or Waves they are not authorized to hold; list DJs who are not booked; oversell capacity; collect ticket revenue and fail to hold the Wave or refund; withhold agreed pay from DJs; apply discriminatory entry or pricing; or circumvent fees (Section 20).
DJs may not: claim sets or bookings that don't exist; buy or fabricate Drifts, followers, or engagement; manipulate Set Pulse; use audience data to contact Riders off-Platform; or upload recordings they don't have rights to.
Venues may not: deny entry to valid ticket holders who meet posted requirements; misstate capacity or licensing; feed false data into Pulse; discriminate at the door; let staff misuse door tools or Rider data; or circumvent fees.
H3. How we enforce
We investigate reports and signals of abuse. Depending on severity, history, and risk to others, we may take one or more of these actions, generally escalating but without being required to follow any order:
- Warning or required correction (for example, fixing a lineup).
- Removing Content, Signals, or listings; excluding manipulated activity from Pulse, Heat, rankings, and attribution history.
- Reducing visibility or limiting features (for example, disabling ticketing, Whisper, or Circle).
- Holding payouts or establishing a reserve, and requiring Organizers to issue refunds to affected Riders.
- Cancelling tickets or orders obtained in violation of these Terms.
- Suspending or permanently terminating accounts, including related and successor accounts.
- Recovering losses — including refunds, chargebacks, fees, and our reasonable costs of investigation and collection — from payouts or directly.
- Reporting to payment processors, Venues, or law enforcement where appropriate.
Immediate action. We may act without prior notice when there is a risk to safety, fraud, legal exposure, or harm to Riders or the Platform.
Fraud and non-delivery. If an Organizer collects ticket revenue and fails to hold the Wave or refund, Currents may refund Riders directly, withhold all pending and future payouts to that Organizer and related accounts, and pursue recovery.
Circumvention. Organizers who violate Section 20 may be charged the fees that would have applied to the diverted sales based on a reasonable estimate, in addition to other remedies.
H4. Reporting and appeals
Report abuse in the app or at info@thecurrentsapp.com. If we restrict your account, we'll tell you what we did and why, unless doing so would compromise safety, an investigation, or the law. You may appeal within 30 days at info@thecurrentsapp.com; a different person will review it. Business users' existing obligations (including refunds owed) survive any restriction.
H5. Safety
Currents is not a substitute for emergency services. If you are in danger, call 911. Venues and Organizers are responsible for on-site safety and security.
Part I — Legal Terms
21. Disclaimers
THE PLATFORM, SIGNALS, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CURRENTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. CURRENTS DOES NOT WARRANT THE CONDUCT OF ANY USER, ORGANIZER, OR VENUE, OR THE SAFETY, QUALITY, OR LEGALITY OF ANY WAVE OR ROOM.
21A. Force majeure
Currents is not liable for delays or failures caused by events beyond its reasonable control. Examples include natural disasters, severe weather, fire, power or internet outages, government orders, police action, labor disputes, epidemics, and failures of third-party services. Riders' refund rights under Part G still apply.
22. Arbitration and class action waiver
(a) Agreement to arbitrate. You and Currents agree to resolve any dispute arising out of or relating to these Terms or the Platform by binding individual arbitration, except that either party may (i) bring an individual claim in small claims court, and (ii) seek injunctive relief in court for intellectual property infringement or misuse of the Platform.
(b) Informal resolution first. Before starting arbitration, the claimant must send a written notice describing the dispute to the other party (info@thecurrentsapp.com for Currents) and attempt in good faith to resolve it for 60 days.
(c) Rules. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules (for consumers) or Commercial Arbitration Rules (for business users). Currents will pay filing and arbitrator fees for consumer claims as required by those rules. The Federal Arbitration Act governs this Section.
(d) Class action and jury waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective, or representative proceeding. You and Currents waive the right to a jury trial.
(e) Mass filings. If 25 or more similar demands are filed by or with the help of the same counsel, they will be administered in batches under the arbitration provider's mass arbitration procedures, and statutes of limitation are tolled while claims wait.
(f) Opt-out. You may opt out of this Section by emailing info@thecurrentsapp.com with your name, account email, and a clear statement that you opt out, within 30 days of first accepting these Terms.
(g) Severability. If the class action waiver is found unenforceable for a claim, that claim will proceed in court and this Section will not apply to it.
23. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CURRENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM ATTENDING A WAVE OR VISITING A ROOM, OR FROM THE CONDUCT OF ANY USER, ORGANIZER, OR VENUE. CURRENTS' TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID OR WERE PAID THROUGH THE PLATFORM IN THE 12 MONTHS BEFORE THE CLAIM, EXCLUDING AMOUNTS PASSED THROUGH TO OTHERS, OR (B) $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
24. Indemnity
You will defend, indemnify, and hold harmless Currents and its officers, directors, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from your Content, your Waves or Room, your violation of these Terms or law, or your conduct. For Organizers and Venues, this includes claims by Riders, performers, staff, and authorities relating to your Waves, Room, alcohol service, safety, and refunds.
25. Termination
You may close your account anytime. We may suspend or terminate access under Part H or if required by law. Sections that by their nature should survive (including fees owed, refunds owed, licenses to distributed Content, disclaimers, liability limits, indemnity, and dispute terms) survive termination.
26. Governing law and venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules, and by the Federal Arbitration Act. For matters not subject to arbitration, the state and federal courts in Fulton County, Georgia have exclusive jurisdiction.
27. General
These Terms, the Privacy Policy, and any separate written Organizer or Venue agreement form the entire agreement. If a separate written agreement conflicts with these Terms, the separate agreement controls for that relationship. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be sent by email or in the app.
27A. Mobile app stores
If you download a Currents app from the Apple App Store or Google Play:
- These Terms are between you and Currents only, not Apple or Google. Currents, not Apple, is solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Currents, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection claims.
- If a third party claims the app infringes its intellectual property, Currents, not Apple, is responsible for investigating, defending, settling, and discharging the claim.
- You confirm that you are not located in a country subject to a U.S. government embargo or designated as supporting terrorism, and that you are not on any U.S. government list of prohibited or restricted parties.
- You must comply with applicable third-party terms, such as your wireless carrier's, when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- If you download from Google Play, Google's applicable terms also apply.
